These Terms govern your use of the Magnet Petals website, builder, checkout, and related services.
1. About Magnet Petals
Magnet Petals is a consumer brand operated by TeezyPeasy LLC, a Pennsylvania limited liability company. References to 'Magnet Petals,' 'we,' 'our,' or 'us' refer to TeezyPeasy LLC acting through the Magnet Petals brand.
2. Eligibility
You must be legally capable of entering into a binding purchase agreement. If you submit photographs or information relating to another person, you represent that you have the right to provide that content for the purpose of producing your order. The purchasing service is intended for adults; minors may use it only with appropriate parent or guardian involvement where permitted.
3. Site Use
You may use the Site only for lawful purposes. You may not interfere with the Site, attempt unauthorized access, introduce malicious code, scrape or exploit the Site in a manner that harms the service, or use it to violate another person's rights.
4. Product Information, Prices, and Taxes
We try to present product descriptions, images, availability, and pricing accurately. Applicable taxes, shipping, and other disclosed charges are shown as part of checkout. We may correct errors before accepting or fulfilling an order to the extent permitted by law.
5. Orders and Payment
By submitting an order, you authorize TeezyPeasy LLC and its payment processor to charge the total amount displayed at checkout. Payments may be processed by Stripe and its payment partners. We may decline or cancel an order for payment failure, suspected fraud, technical or pricing error, prohibited content, inability to manufacture, or another legitimate legal or business reason. If we cancel a paid order before fulfillment, we will provide the applicable refund.
6. Personalized Orders
Personalized Magnet Petals orders are also governed by the Magnet Petals Customer Agreement, including the rules concerning submitted images, crop and preview approval, warnings, custom-product cancellation, production variation, and remedies.
7. Customer Content
You retain ownership of content you submit. You grant TeezyPeasy LLC only the limited rights reasonably necessary to operate the Site, save a design where applicable, produce and fulfill your order, provide customer service, and make an authorized replacement or remake. Public or promotional use requires separate permission.
8. Magnet Petals Intellectual Property
The Magnet Petals name, logo, hex-flower marks, website content, product graphics, proprietary centerpiece artwork, written content, and other original brand materials are owned by TeezyPeasy LLC or applicable licensors and protected by applicable intellectual-property laws.
9. Third-Party Services
The Site may rely on third-party providers for hosting, payments, analytics, communications, security, shipping, or fulfillment. Those providers may have their own terms and privacy practices.
10. Shipping
Production and delivery estimates are not guarantees unless expressly stated. If fulfillment is delayed, we will provide notices, revised timing, cancellation opportunities, or refunds as required by applicable law.
11. Returns, Refunds, and Cancellations
Returns, remakes, refunds, and cancellations are governed by the Magnet Petals Returns / Refund / Cancellation Policy and, for personalized orders, the Customer Agreement.
12. Website Availability
We may change, update, suspend, or discontinue parts of the website or builder when reasonably necessary. We do not guarantee uninterrupted or error-free access, or that saved sessions will remain available indefinitely.
13. Limitation of Liability
To the fullest extent permitted by law, TeezyPeasy LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of the Site. Nothing in these Terms limits liability, warranties, remedies, or consumer protections that cannot legally be limited.
14. Unauthorized Submissions
To the extent permitted by law, you are responsible for claims arising from content you submit without the rights or permissions required by these Terms or the Customer Agreement. This does not make you responsible for our own negligence, misconduct, or unauthorized use.
15. Changes to These Terms
We may update these Terms prospectively. The effective date and version identify the current published terms. The version in effect when you place an order will govern that order unless applicable law requires otherwise.
16. Governing Law and Venue
These Terms are governed by Pennsylvania law where permitted, without overriding mandatory consumer protections that apply based on a customer's location. Any forum or venue requirement is subject to applicable law.
17. Severability
If a provision is found unenforceable, the remaining provisions remain effective to the extent permitted by law.
